Terms of Service

Welcome to edugaa. These Terms of Service ("Terms") are a binding agreement between you and the operator of edugaa ("edugaa," "we," "us," or "our") and govern your access to and use of the edugaa website, applications, and related services (together, the "Service"). By creating an account, or by accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
Please read Section 13 (Disputes) and Section 12 (Limitation of Liability) carefully. They affect your legal rights, including how disputes are resolved and the extent of our liability to you.
1. Eligibility & age
You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction (typically 18), you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf. By using the Service you represent that you meet these requirements and that you have the legal capacity to enter into these Terms. The Service is not directed to children under 13, and we do not knowingly permit them to register.
2. Your account
To use most features you must create an account. You agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for:
- maintaining the confidentiality of your login credentials;
- all activity that occurs under your account; and
- notifying us promptly at support@edugaa.com of any unauthorized use or security breach.
You may sign in using an email magic link or a third-party provider such as Google. You are responsible for keeping access to that email or account secure. You may not share your account, or create an account on behalf of anyone else without authority to do so.
3. The Service & beta status
edugaa turns content you provide, such as documents, links, images, or text, into personalized learning materials including notes, flashcards, quizzes, progress tracking, and an AI tutor. Features, limits, and availability may change as the product evolves.
Beta.The Service is currently offered in beta. This means it is under active development, may contain bugs or incomplete features, may change or be discontinued at any time, and may occasionally be unavailable. We provide the Service on an "as available" basis and do not guarantee any particular level of availability, performance, or feature set during the beta period.
4. Plans, billing & cancellation
Free and paid plans
We offer a free plan with limited usage and one or more paid plans ("Pro") with expanded features. The features and limits of each plan are described on our pricing page and may be updated from time to time.
Recurring billing & auto-renewal
Paid plans are billed in advance on a recurring basis (monthly or annually, as you choose) through our payment processor, Stripe. Your subscription renews automatically at the end of each billing period at the then-current price, unless you cancel beforehand. By subscribing, you authorize us and Stripe to charge your payment method for each renewal until you cancel.
Cancellation
You may cancel at any time from Settings → Manage billing. Cancellation takes effect at the end of the current billing period; you keep access to paid features until then, and you will not be charged again after cancellation.
Refunds
Except where required by applicable law, payments are non-refundable and we do not provide refunds or credits for partial billing periods, unused time, or features not used. If applicable consumer law grants you a right to a refund or to withdraw, that right is unaffected by this section.
Taxes & price changes
Prices are exclusive of taxes unless stated otherwise; you are responsible for any applicable taxes, which may be added at checkout. We may change our prices or plan features; we will give you reasonable advance notice of a price increase that applies to your next renewal, and the new price applies only after the notice period. If you do not agree, you may cancel before it takes effect.
5. Your content & licence to us
"Your Content" means the documents, links, images, text, prompts, and other materials you upload or submit to the Service, and the learning materials generated for you from them. As between you and us, you retain all ownership rights in Your Content.
You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, adapt, and display Your Content solely to operate, provide, secure, and improve the Service for you, and as otherwise described in our Privacy Policy. This licence ends when you delete Your Content or your account, except that we may retain residual copies for a limited period in backups and as required by law.
You represent and warrant that you own or have the necessary rights and permissions to submit Your Content and to grant this licence, and that Your Content and your use of the Service do not infringe or violate the rights of any third party or any law.
6. Acceptable use
You agree not to, and not to permit anyone else to:
- use the Service for any unlawful, infringing, fraudulent, harmful, or abusive purpose, or to generate such content;
- upload content you do not have the right to use, or that infringes intellectual property, privacy, or other rights;
- attempt to disrupt, overload, or gain unauthorized access to the Service, other accounts, or our systems or networks;
- reverse-engineer, decompile, scrape, or copy the Service or its underlying technology, except to the extent this restriction is prohibited by law;
- resell, sublicense, or commercially exploit the Service without our written permission;
- use automated means to access the Service in a way that exceeds normal use or circumvents plan limits, rate limits, or usage controls; or
- use the Service to build or train a competing product or model.
Additional rules for AI features are set out in our AI Policy, which is incorporated into these Terms. We may investigate and take appropriate action, including removing content and suspending or terminating accounts, for suspected violations.
7. AI-generated content
Notes, quizzes, tutor responses, and other materials are generated using artificial intelligence and may be inaccurate, incomplete, or out of date. The Service is an educational aid only and is not a substitute for professional advice, including medical, legal, financial, or academic advice. You are responsible for reviewing and verifying AI outputs before relying on them, and for ensuring your use complies with the rules of any school, employer, exam board, or institution. Given the nature of generative AI, outputs may be similar to content generated for other users, and we make no guarantee of originality, accuracy, or fitness for a particular purpose.
8. Our intellectual property
The Service, including its software, design, text, graphics, logos, and the edugaa name and brand, is owned by us or our licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your own learning. We reserve all rights not expressly granted. You may not use our name, logo, or branding without our prior written permission.
9. Feedback
If you send us ideas, suggestions, or feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use them for any purpose without any obligation or compensation to you.
10. Third-party services
The Service relies on third-party providers (for example, Stripe for payments, Google for AI and sign-in, Supabase for authentication and data, and Vercel for hosting) and may link to third-party sites or content. We are not responsible for third-party services or content, and your use of them may be subject to their own terms. See our Privacy Policy for how these providers process data.
11. Copyright complaints
We respect intellectual property rights. If you believe content on the Service infringes your copyright, contact us at legal@edugaa.com with enough detail to identify the work and the allegedly infringing material, your contact information, and a statement of good-faith belief. We may remove infringing content and terminate repeat infringers.
12. Disclaimers & limitation of liability
To the fullest extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty as to accuracy, reliability, or uninterrupted or error-free operation.
To the fullest extent permitted by law, edugaa and its operators, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or opportunity, arising out of or relating to the Service, even if advised of the possibility. Our total aggregate liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) USD 50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; in that case our liability is limited to the smallest extent permitted by law.
13. Indemnification
You agree to indemnify and hold harmless edugaa and its operators from and against any claims, damages, liabilities, and reasonable expenses (including legal fees) arising out of your Content, your use of the Service, or your violation of these Terms or of any law or third-party right.
14. Suspension & termination
You may stop using the Service and delete your account at any time from Settings. We may suspend or terminate your access, with or without notice, if you violate these Terms, if required by law, to protect the Service or other users, or if we discontinue the Service. On termination, your right to use the Service ends and we may delete Your Content, subject to our Privacy Policy and legal obligations. Sections that by their nature should survive termination (including ownership, disclaimers, liability, indemnity, and disputes) will survive.
15. Governing law & disputes
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws applicable in the jurisdiction in which the operator of edugaa is established, without regard to conflict-of-laws rules, and subject to any mandatory consumer-protection rights available to you in your country of residence.
Informal resolution first. Before starting any formal proceeding, you agree to contact us at legal@edugaa.com and try to resolve the dispute informally in good faith for at least 30 days. Most concerns can be resolved this way.
To the extent permitted by law, you and edugaa agree that disputes will be resolved on an individual basis and waive any right to participate in a class or representative action. Nothing in these Terms limits rights that cannot be waived under the law that applies to you.
16. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, for example by posting a notice or emailing you, and we will update the "Last updated" date above. Changes take effect when posted unless stated otherwise. Your continued use of the Service after changes take effect means you accept the updated Terms; if you do not agree, you should stop using the Service.
17. General
- Entire agreement. These Terms, the Privacy Policy, and the AI Policy are the entire agreement between you and us regarding the Service.
- Severability. If any provision is found unenforceable, the rest remains in effect.
- No waiver. Our failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
- Notices. We may provide notices to you by email or within the Service.
